By accessing the McKenzie Æon website or engaging our services, you agree to these Terms of Service. These terms govern the relationship between you ("Client") and McKenzie Æon ("Agency"). If you do not agree, please do not use our services.

Services

McKenzie Æon provides creative strategy, branding, web design, automation, and marketing services. The specific scope of work, deliverables, and timeline will be outlined in your specific project invoice or agreement.

Payments

  • Invoicing: Invoices are due upon receipt unless otherwise specified.

  • Deposits: A non-refundable deposit is required to secure your spot in our production schedule.

  • Final Payment: Final deliverables (source files, website ownership transfer, automation keys) are released only after full payment has been received.

  • Late Fees: We reserve the right to pause work or charge late fees on overdue invoices.

Intellectual Property

  • Client Ownership: Upon full payment, you own the rights to the final approved deliverables (e.g., the final logo files, the live website).

  • Agency Rights: McKenzie Æon retains the right to display the work in our portfolio, social media, and marketing materials for promotional purposes.

  • Background Technology: We retain ownership of any pre-existing code, methodologies, or templates used to create your deliverables.

Revisions and Approvals

  • Scope: The number of included revisions is defined in your specific package or agreement.

  • Excess Work: Requests outside the original scope or exceeding the allotted revision count will be billed at our standard hourly rate.

  • Approval: Once a deliverable is approved and finalized, any further changes are considered new projects.

Third-Party Tools & AI

  • Platforms: We utilize third-party platforms (e.g., Squarespace, Shopify, Tidio) and AI models (e.g., OpenAI, Google Gemini) to build your systems. We are not responsible for changes to their pricing, terms, or service availability.

  • AI Disclaimer: While we engineer automation for high accuracy, AI outputs can vary. We are not liable for hallucinations or errors generated by underlying AI models during your operation of the system.

Limitation of Liability

To the maximum extent permitted by law, McKenzie Æon shall not be liable for any indirect, incidental, or consequential damages, including lost profits or business interruption, arising from your use of our services or deliverables. Our total liability is limited to the amount you paid for the specific service in question.

Termination

We reserve the right to refuse service or terminate a project if a client violates these terms, fails to make payments, or engages in conduct that we determine is inappropriate or hostile. In such events, you will be billed for all work completed up to the date of termination.
